The federal Public Health Emergency (PHE), declared pursuant to Section 319 of the Public Health Service (PHS) Act in response to the COVID-19 pandemic, expired May 11. As a result, the Biden administration during the next few months will transition its COVID-19 policies and certain administrative and regulatory flexibilities enabled by the COVID-19 emergency declarations.
The U.S. Department of Health and Human Services (HHS) has detailed information on how the transition will affect various aspects of patient care and provides information on waivers and other flexibilities at the HHS COVID-19 Public Health Emergency webpage.
