The White House issued an executive order Dec. 11 to preempt state laws that conflict with federal priorities and to work toward a national AI policy framework. The order tells federal agencies to review state AI rules and challenge or disincentivize those of concern.
The attorney general was directed to form an AI Litigation Task Force to target state laws. The U.S. Department of Commerce will help evaluate those laws. Agencies may withhold certain federal funds, including broadband expansion money, from states that enforce the targeted requirements of concern.
The administration will also develop a legislative recommendation for a uniform federal AI policy framework.
The order could affect healthcare AI laws and discourage new state legislation, but its future impact remains unclear. Congress failed to pass similar measures when asked to do so by the White House, signaling possible challenges ahead.
