HHS issued an enforcement alert Sept. 4, reminding actors — which includes healthcare providers, health information networks or exchanges and developers of certified health IT — that information blocking rules remain in effect and investigation-confirmed violations will be penalized. The alert does not revise HHS’ current regulations or guidance.  

Information blocking by a healthcare provider means the actor knows a given practice is unreasonable and likely to interfere with, prevent, or materially discourage access, exchange, or use of electronic health information (EHI). Providers are subject to disincentives for violating information blocking rules.
