Pennsylvania House of Representatives passed House Bill 1925, legislation establishing requirements for the use of AI in clinical care and health insurance utilization review, by a vote of 144–59 Sept. 30. The bill was amended before passage and is now pending in the Senate Institutional Sustainability and Innovation Committee.

As amended, HB 1925 would require healthcare facilities, including imaging centers and physician practices, to disclose AI use in clinical decision-making through website postings and written patient notifications, including general treatment consent forms. Patient notifications would be required only once per episode of care. The legislation also establishes disclosure requirements for certain personalized AI-generated patient communications, requires at least annual reviews of AI system performance and prohibits AI from superseding healthcare providers' independent clinical judgment.

The legislation also addresses AI use by health insurers, including Medicaid and CHIP managed care plans. Before issuing or upholding adverse coverage determinations, including prior authorization denials, healthcare professionals conducting utilization review would be required to review individual clinical records, document their review and exercise independent judgment rather than rely on AI recommendations.

Looking ahead to the 2027 state legislative sessions, lawmakers nationwide are expected to introduce an increasing number of proposals regulating AI in healthcare, including clinical applications, patient disclosures, physician oversight, and insurer utilization review, while seeking to support responsible innovation. These proposals will become important opportunities for ACR® and state radiological societies to advocate for policies that protect patients and preserve physician decision-making.

ACR’s State Government Relations Committee is available to assist state societies considering advancing legislation related to AI in healthcare. For more information or if you have questions, contact Eugenia Brandt, ACR Senior Government Relations Director.
