The Department of Health and Human Services has announced proposed changes to the regulations that interpret the Physician Self-Referral Law (the “Stark Law”) and the Federal Anti-Kickback Statute.
The proposed rules — a CMS Rulemaking addressing the Stark Law and an Office of Inspector General (OIG) Rulemaking addressing the Federal Anti-kickback statute — are intended to provide greater certainty for health care providers who participate in value-based arrangements and provide coordinated patient care.
Agency-produced fact sheets on the Self-Referral -— and the Anti-Kickback Safe Harbors — proposed rules outline the major provisions for each set of proposals.
