HHS Proposes Stark Law and Anti-Kickback Rules Changes

The Department of Health and Human Services has announced proposed changes to the regulations that interpret the Physician Self-Referral Law (the “Stark Law”) and the Federal Anti-Kickback Statute.

The proposed rules — a CMS Rulemaking addressing the Stark Law and an Office of Inspector General (OIG) Rulemaking addressing the Federal Anti-kickback statute are intended to provide greater certainty for health care providers who participate in value-based arrangements and provide coordinated patient care.

Agency-produced fact sheets on the Self-Referral - and the Anti-Kickback Safe Harbors  proposed rules outline the major provisions for each set of proposals.

The American College of Radiology® is reviewing the proposed rules and is planning to submit comments in response to the Notice of Proposed Rulemakings. Please monitor Advocacy in Action eNews for updates on this issue.
